Terms & conditions

These are the terms you agree to when you use our site or buy from us. We have written them in plain English so they are actually readable. If anything below is unclear, get in touch and we will explain.

Nothing in these terms takes away your statutory rights as a UK consumer. The Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 give you a baseline of protection that we have to honour, no matter what these terms say.

1.Who we are

MAAREE is a UK sports performance apparel brand. We design and sell sports bras and other apparel for women, engineered around our protected Overbandยฎ Technology. Mari Thomas-Welland founded the company in 2018.

References to "we", "us" and "our" in these terms mean MAAREE Ltd. References to "you" and "your" mean you, the person using the site or buying from us.

2.Using the site

You can browse, shop, leave a review, book a free fitting, subscribe to emails, and get in touch with us through the site. By using the site you agree to these terms and to our privacy policy.

You need to be at least 18 to buy from us, or to have a parent or guardian buying for you.

These terms cover purchases by individual consumers buying for personal use. If you want to stock MAAREE in your shop or studio, head to our become a stockist page. Wholesale and B2B purchases are covered by a separate agreement.

3.The contract between us

When you place an order, you are making us an offer to buy. The contract between us forms when we send you a dispatch confirmation email, not when you click "place order" and not when payment is taken. Until that point, we may decline your order for any reason, including:

  • The item is out of stock.
  • There was a pricing or product description error we need to correct.
  • We could not authorise your payment.
  • We suspect the order is fraudulent.
  • You are based in a country we cannot ship to.

If we decline your order, we will refund any payment in full and let you know why.

4.Prices, currency and errors

The price of an item is the price shown on the product page at the time you place your order. Prices include VAT where applicable.

The site supports multiple currencies. The currency you see depends on the country selector at the top of the page or, on first visit, your detected location. Currency conversions are handled by Shopify Markets and update from time to time.

Customs duties and import taxes for international orders are your responsibility and are not included in the price you pay us. Where Shopify can calculate duties at checkout, we will show them; otherwise, your local courier or customs authority may charge you on delivery.

We try hard to make sure prices are correct on the site. If we spot a pricing error after you have placed an order, we will let you know before we accept the order. You can then choose to proceed at the corrected price or cancel for a full refund.

5.Delivery

We will dispatch your order within the timeframe shown at checkout. Delivery times are estimates, not guarantees, and can be affected by courier delays, customs holds, or unusually busy periods.

Once we hand your parcel to the courier, the risk of loss or damage transfers to you. If something arrives damaged, missing, or different from what you ordered, tell us and we will sort it out, in line with the rights set out in section 6.

6.Returns, cancellation and refunds

Your 14-day right to cancel

UK law gives you 14 days from the day you receive your order to change your mind and cancel, with no reason needed. You then have a further 14 days to send the goods back to us. We will refund you within 14 days of getting the goods back (or, if sooner, within 14 days of receiving evidence you have sent them).

To exercise this right, tell us in writing that you want to cancel before the first 14 days are up. You can also use the model cancellation form set out in the Consumer Contracts Regulations 2013, but you do not have to.

The 14-day cancellation right does not apply to:

  • Items returned in a state we cannot resell, including items worn beyond a brief try-on.
  • Sealed hygiene products that have been unsealed (this rarely applies to our range, but worth flagging).
  • Made-to-order or personalised items.
  • Digital gift cards, once the code has been issued.

Faulty, mis-described or wrong items

Under the Consumer Rights Act 2015, the goods we sell must be of satisfactory quality, fit for purpose, and as described. If they are not, you have a legal right to:

  • A full refund within 30 days of receiving the goods.
  • A repair or replacement after that, at our cost.
  • A partial or full refund if a repair or replacement is not possible.

These rights are in addition to the 12-month sports bra warranty in section 7.

Voluntary returns policy

On top of your statutory rights, we offer a longer voluntary returns window for unworn items in their original packaging. The current window, the conditions, and the return process are all on our delivery and returns page.

How refunds are paid

Refunds go back to the original payment method. Card refunds usually clear within 3 to 5 working days; PayPal and Klarna may be quicker or slower depending on their own systems. Original delivery charges are refundable for cancellations within the 14-day window, in line with the law; return postage is your responsibility unless the item is faulty or wrong.

7.Our guarantees

Two voluntary guarantees sit on top of your statutory rights. They give you more, never less, than UK consumer law requires.

The 12-month sports bra warranty

Every MAAREE sports bra is backed by a 12-month warranty against manufacturing defects. The full conditions, including how to make a claim and what is and is not covered, live on our sports bra warranty page.

The 90-day chafe-free guarantee

Every fitting comes with a 90-day chafe-free guarantee. If a bra you have been fitted in is rubbing or chafing, get back in touch within 90 days and we will work with you to fix it. The full conditions are on our chafe-free guarantee page.

These guarantees apply to the original purchaser only and are in addition to your rights under the Consumer Rights Act 2015. They do not affect those rights.

8.Free fittings

We offer free 1:1 fittings with one of our expert fitters. You can book a virtual fitting on Zoom or an in-person fitting at one of our partner locations. A fitting takes around 20 minutes.

Fittings are genuinely free. There is no obligation to buy anything during or after a fitting. The aim is to find your right size, even if that turns out to be a brand we don't sell.

We can only fit you for what we make. We do not provide measurements for use elsewhere, and we cannot give medical advice or fit for post-surgical support garments.

Bookings are managed through Calendly. By booking, you agree to Calendly's terms in addition to ours, and you agree to the limited data-sharing described in our privacy policy.

9.Gift cards

We sell digital gift cards in fixed denominations. They can only be redeemed against purchases on our site, in the currency they were issued in.

  • Gift cards cannot be exchanged for cash or refunded to a different card.
  • Gift cards cannot be used to buy more gift cards.
  • Gift cards are valid for the period shown on the card and at minimum the period required by UK law.
  • If your order total is less than the gift card balance, the remainder stays on the card for next time.
  • If your order total is more than the balance, you can pay the difference on your usual payment method.
  • If you lose your gift card code, contact us. We may be able to help if we can verify the original purchase.

The 14-day cancellation right does not apply to digital gift cards once the code has been issued, in line with the Consumer Contracts Regulations 2013.

10.Customer accounts

You can create a customer account on the site, but you don't have to. An account makes it easier to track orders, save addresses, and manage your details.

If you create an account, you are responsible for keeping your login secure. Don't share your password. Tell us as soon as possible if you think someone else has accessed your account.

We may suspend or close an account that we reasonably believe is being used in breach of these terms, to defraud us, or to abuse our staff. If you want to close your account, ask us through the contact form and we will sort it.

11.Promotions and discount codes

Can I use more than one offer at the same time?

Usually no. Offers cannot be combined or stacked. Some promotions allow a free gift alongside a discount on a specific item; if so, the offer message will say so. If two offers apply to the same product, the system will apply the better of the two.

Who can use our offers?

Offers are available to customers shopping on the official MAAREE website. Some are open worldwide; others are UK-only. The offer message will say which.

How free gifts work

Free gifts are subject to availability and may vary in colour or style. One free gift per order, unless we say otherwise. If you return an order that included a free gift, send the gift back too, unused and in its original packaging. If you do not, we may deduct the value of the gift from your refund.

Time-limited offers

Offers are valid only within the time window shown in the promotional message. Orders placed after the offer ends will not qualify, even if items were already in your basket. The system clock at checkout is the deciding clock.

Product, size and shipping restrictions

Some products, sizes or collections may be excluded from a promotion. Free gifts are sometimes UK-only because of shipping restrictions. Normal delivery charges, taxes and duties still apply during a promotion unless the offer specifically removes them.

Past purchases, transfers, and resale

Offers cannot be applied to a past purchase, redeemed for cash, or transferred to another person. Codes shared publicly that were intended for a specific list (a Klaviyo segment, an athlete's audience) may be voided at our discretion.

If you return an order with a discount

If a return takes your order below the threshold the offer needed, the discount or free gift value may be removed before we process your refund. Refunds will reflect the amount actually paid after any discounts were applied.

Other things worth knowing

We may change or withdraw a promotion at any time without notice. All offers are subject to availability. We are not responsible for technical issues at checkout that prevent a discount from applying, but if that happens, tell us as soon as you can and we will do our best to put it right.

12.Reviews, feedback and user content

You can leave reviews on the site, send us feedback, and tag us in social posts. We love it when you do.

If you submit a review, photo, video, comment, or any other content to us or about us through the site, social media, or email, you give us permission to use it across our marketing channels: the site, email, ads, social, in-store displays, and press. We will credit you wherever practical. You can ask us to take your content down at any time by getting in touch.

You confirm that any content you send us is yours to share, that it does not infringe anyone else's rights, and that it is not defamatory, threatening, obscene, or illegal. We may edit, refuse, or remove content that breaks these rules.

We do not pay for unsolicited reviews or content, and we are not obliged to respond to every submission, though we usually try.

13.Acceptable use of the site

Use the site how you would expect: browse, buy, leave reviews, ask questions, book a fitting. Don't:

  • Try to break the site, scrape it, or replicate it.
  • Use it to harass, defame, or discriminate against anyone.
  • Upload viruses, malware, or any code intended to interfere with the site or our customers' devices.
  • Pretend to be someone you are not, or use the site to commit fraud.
  • Bulk-buy stock with the intention of reselling it through unauthorised channels.
  • Use automated tools (bots, crawlers, scripts) to interact with the site without our written permission.

If we reasonably think you are breaking these rules, we may suspend or end your access to the site, cancel your orders, and pursue any losses we suffer through the courts.

14.Intellectual property

The site, the photography, the writing, the product designs, the technology, and the names below all belong to MAAREE Ltd. or our licensors. You can browse the site, share links to our pages, and repost our public social content with credit. Anything beyond that, ask first.

"MAAREE", the MAAREE wordmark and logo, and "Overbandยฎ Technology" are trademarks of MAAREE Ltd. Our protected Overbandยฎ is the result of years of engineering and is not free to copy.

Reviews, photos and other user content remain owned by their authors, but used by us under the licence in section 12.

15.Our liability to you

We will do what we say we will do, and we stand behind the things we sell. Where things go wrong, our liability is limited as set out below.

What we limit

Our total liability to you for any claim arising from your use of the site or your order, whether in contract, tort (including negligence), or otherwise, is limited to the price you paid for the goods or service the claim relates to.

We are not liable for losses that were not foreseeable at the time the contract was made, or for losses that result from your own breach of these terms.

We are not liable for the content, products, or services of third-party websites the site links to.

What we cannot limit

Nothing in these terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Defective products, under the Consumer Protection Act 1987.
  • Breach of the terms implied by the Consumer Rights Act 2015.
  • Any other liability that cannot be limited or excluded under UK law.

Your statutory rights as a UK consumer are not affected by anything in this section.

16.Complaints and disputes

If something has gone wrong, please tell us first. Most things we can fix in a single message. We aim to resolve any complaint within 14 days.

If you are not happy with how we have handled a complaint, UK consumers can take the matter to:

  • Their local Citizens Advice for free guidance.
  • An alternative dispute resolution provider. We do not currently subscribe to a specific scheme; we are happy to consider one if proposed.
  • The small claims court in the civil courts of England and Wales for claims of low value.

EU consumers retain rights under their local law that cannot be excluded by contract.

17.Changes to these terms

We update these terms when the law changes or when we change how we work. The "last updated" date at the top of the page tells you when we last revised them. If a change is significant, we will flag it in our newsletter or on the site so you do not have to come hunting for the difference.

The version of the terms that applies to your order is the version in force on the day you placed the order. We will keep older versions on file for 12 months and can send you a copy on request.

18.General

If a court decides that any part of these terms is unlawful, void, or unenforceable, the rest of the terms still apply. The unenforceable part will be cut down to the minimum necessary or removed entirely, and the rest stands.

If we do not enforce a right immediately, that does not mean we have given it up.

These terms, together with our privacy policy, our delivery and returns page, our sports bra warranty, our chafe-free guarantee, and any specific terms attached to a promotion, set out the full agreement between you and MAAREE. Anything said in conversation with our staff or partners that contradicts these terms is not binding unless we have written it down and signed it.

You cannot transfer your rights or obligations under these terms to anyone else without our written consent. We may transfer ours if our business is sold or restructured, with your rights as a consumer protected.

19.Governing law and jurisdiction

These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction over any dispute that arises from them.

If you are a consumer based outside England and Wales, you may also be able to bring proceedings in your local courts under your local consumer law. Nothing in this section takes away that right.
